Indian entities that have received foreign direct investment, or made overseas direct investment, in the previous year or earlier must file the Annual Return on Foreign Liabilities and Assets with the RBI. This includes companies, LLPs and certain other entities.
The return is filed online on the RBI’s FLAIR portal by 15 July each year, based on the accounts of the financial year ending on 31 March. If the accounts are not audited by then, it can be filed on unaudited figures and revised later.
Key points
- Due by 15 July every year
- Applies to entities with outstanding FDI or ODI
- Filed on the RBI FLAIR portal
- Unaudited figures allowed, with revision after audit
- Non-filing is treated as a FEMA contravention
